PepLoom records the schedule you choose. It does not provide medical advice. It does not recommend doses, combinations or injection sites, and it is not a medical device. Always follow your clinician’s instructions.
1.Who we are and this agreement
PepLoom is provided by Charbel Samaha (“we”, “us”). These Terms of Use (“Terms”) apply to the PepLoom iPhone app, its optional private cloud backup and this website (together, “PepLoom”).
By downloading or using PepLoom, you agree to these Terms. If you do not agree, please do not use PepLoom.
2.Who can use PepLoom
You must be at least 18 years old to use PepLoom. By using it, you confirm that you are.
3.Not medical advice
PepLoom is a record-keeping tool for a schedule that you decide on, usually with a clinician. In particular:
- PepLoom does not provide medical, pharmaceutical or health advice, and nothing in the app or on this website is a recommendation to take, stop or change any substance.
- PepLoom is not a medical device. It does not diagnose, treat, cure, monitor or prevent any condition.
- PepLoom does not recommend doses, timing, combinations or injection sites, and it does not calculate doses. A recorded injection location is a record of what you entered, not guidance.
- The built-in name list is provided for convenience only. A name appearing in the list does not mean that a substance is approved, legal, appropriate or safe for you.
- Reminders are a convenience. iOS may delay or silence notifications, so always rely on your own plan.
Consult a qualified clinician before starting, stopping or changing any treatment, and about any question you have about your health. Never ignore professional advice or delay seeking it because of something in PepLoom. In an emergency, contact your local emergency services.
4.Your entries and responsibilities
- You are responsible for what you enter in PepLoom and for checking that it is accurate. PepLoom shows the information you entered; it does not verify it.
- You are responsible for your own health decisions and for complying with the laws that apply to you, including laws about any substance you record.
- Keep your iPhone secure, for example with a passcode. Anyone who can unlock your device may be able to see your records.
- Your records are stored on your iPhone and are not included in iCloud or computer backups of your device. Keep your own exports (Settings → Export all records) or use the optional private cloud backup if you want a copy elsewhere.
5.Plans, subscriptions and billing
PepLoom’s tracking features require a paid plan: a monthly or yearly auto-renewing subscription, or a one-time lifetime purchase. All purchases are made through Apple’s App Store. Prices and plan details are shown in the app, in your local currency, before you confirm a purchase.
- Payment. Payment is charged to your Apple Account when you confirm the purchase. If you start an eligible free trial, payment is charged when the trial ends, unless you cancel before then.
- Automatic renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the current period ends. Your Apple Account is charged for renewal within the 24 hours before the current period ends.
- Managing and cancelling. You can manage or cancel a subscription in your Apple Account settings (on iPhone: Settings → your name → Subscriptions) or with “Manage subscriptions” in PepLoom. If you cancel, access continues until the end of the period you have already paid for.
- Free trial. The yearly plan may include a free trial for eligible customers. The app shows whether you are eligible before you confirm. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Lifetime purchase. Lifetime access is a one-time, non-renewing purchase. It does not cancel an existing subscription automatically; cancel that separately in your Apple Account settings.
- Refunds. Apple handles all payments and refunds under its own policies. We cannot issue refunds directly. You can request one at reportaproblem.apple.com.
- Deleting is not cancelling. Deleting the app or erasing your records does not cancel a subscription.
- Your data without a plan. Exporting, restoring and erasing your records, and erasing or deleting cloud backup data, remain available without a paid plan.
6.Apple’s license terms
Your license to use the PepLoom app is granted under Apple’s Licensed Application End User License Agreement (“Apple EULA”). These Terms add to the Apple EULA. If anything in these Terms conflicts with the Apple EULA, the Apple EULA applies to the extent of the conflict.
These Terms are between you and us, not Apple. Apple is not responsible for PepLoom or its content, and has no obligation to provide maintenance or support for it.
7.Optional private cloud backup
Cloud backup is optional and off unless you turn it on. If you use it:
- You sign in with Sign in with Apple. Nothing is uploaded until you choose to back up.
- The service runs on a free hosting tier. We do not guarantee that it will always be available, fast or free of errors. It may be rate-limited or temporarily unavailable, and it holds up to 1 MiB of records per account.
- Backups are encrypted in transit but are not end-to-end encrypted. The Privacy Policy explains exactly what is stored and who can access it.
- You can erase the cloud copy or delete your cloud account at any time in the app. Deleted data may remain in our hosting provider’s backups for up to 7 days.
- Keep your own JSON exports of anything important. Cloud backup is a convenience, not the only copy you should rely on.
- We may change or discontinue cloud backup. If we discontinue it, we will try to tell you in the app in advance so you can keep your records on your iPhone or export them.
- We may suspend access to cloud backup for an account that is used in breach of Section 8, or where needed to protect the service or other users.
8.Acceptable use
Please use PepLoom only for its purpose: keeping your own records. You agree not to:
- use PepLoom for any unlawful purpose
- try to access another person’s account or data, or any part of the service you are not authorized to access
- interfere with, overload or disrupt the cloud backup service, for example with automated or excessive requests
- probe, scan or test the service for vulnerabilities without our written permission (if you find a security issue, please tell us at the address below)
- copy, modify, decompile or reverse engineer the app, except where the law allows this despite this restriction
- use the cloud backup to store anything other than your PepLoom records
9.Intellectual property
PepLoom, including its software, design, name and icon, belongs to us and is protected by intellectual-property laws. These Terms do not give you any right to use our name or branding.
Your records belong to you. We claim no ownership of what you enter. If you use cloud backup, you allow us to store and transmit your backup only as needed to provide that service to you.
10.Privacy
Our Privacy Policy explains what data PepLoom handles and the choices you have. Please read it together with these Terms.
11.Disclaimers
We work hard to make PepLoom reliable, but to the extent permitted by law, PepLoom is provided “as is” and “as available”. We do not promise that it will be uninterrupted, error-free or suitable for any particular purpose, or that records, reminders, streaks, counts or other displays will always be complete or accurate.
Nothing in these Terms excludes or limits any right you have under consumer-protection laws that cannot be excluded or limited by agreement.
12.Limitation of liability
To the extent permitted by law:
- we are not liable for any indirect, incidental, special or consequential loss, or for any loss of data, arising from your use of PepLoom
- we are not liable for decisions you make, or actions you take, based on information you entered in PepLoom
- our total liability to you for any claim relating to PepLoom is limited to the amount you paid for PepLoom in the 12 months before the claim arose
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, such as liability for fraud, or for death or personal injury caused by negligence where the law does not allow that liability to be limited.
13.Ending your use
You can stop using PepLoom at any time. Before deleting the app, export any records you want to keep. You can erase your local records in Settings and erase your cloud copy or delete your cloud account in the app. Remember that deleting the app does not cancel a subscription.
14.Changes to these terms
We may update these Terms, for example when PepLoom changes or the law requires it. We will post the new version on this page and change the effective date. If a change is material, we will tell you in the app before it takes effect. If you keep using PepLoom after a change takes effect, the updated Terms apply. If you do not agree with them, stop using PepLoom and cancel any subscription.
15.Governing law
These Terms are governed by the laws of Lebanon. Any dispute relating to them is subject to the jurisdiction of the competent courts of Lebanon. If you use PepLoom as a consumer, you keep the protection of any mandatory provisions of the law of the country where you live, and nothing in this section stops you from bringing a claim in the courts where you live if that law allows it.
